Terms of Service

These Terms of Service ("Terms") govern your use of the CourtTime web application (the "Service") operated by CourtTime ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of the Service, you must create an account by providing your phone number and first name. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary. You must notify us immediately of any unauthorized use of your account.

3. SMS Communications

By creating an account, you consent to receive SMS messages from CourtTime at the phone number you provide. These include verification codes for authentication, session-related notifications (reminders, cancellations, updates), and invitations from other users. Message frequency varies. Message and data rates may apply.

You may opt out of non-essential SMS notifications at any time by replying STOP to any CourtTime message or adjusting your notification settings within the Service. You may not opt out of verification code messages, which are required for account security.

4. Acceptable Use

You agree to use the Service only for its intended purpose of coordinating court sport sessions with other users. You agree not to: use the Service for any unlawful purpose; impersonate any person or entity; harass, abuse, or harm other users; transmit spam, unsolicited messages, or promotional material through the Service; attempt to gain unauthorized access to any part of the Service; interfere with or disrupt the Service or its infrastructure; or use the Service to collect personal information about other users without their consent.

5. User Content

You retain ownership of any content you submit to the Service, including session details, group names, and profile information ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely for the purpose of operating and providing the Service.

You are solely responsible for your User Content. You represent that you have all necessary rights to submit your User Content and that it does not violate any third party's rights.

6. Sessions and Court Bookings

CourtTime facilitates the coordination of playing sessions between users. We do not guarantee the availability of courts, the attendance of other users, or the quality of any playing experience. Users are responsible for confirming court availability and complying with all rules and regulations of the facilities they use.

If CourtTime offers court booking features, any bookings are subject to the policies of the facility providing the court. Cancellation and refund policies for court bookings are determined by the respective facility. CourtTime acts as an intermediary and is not responsible for disputes between users and facilities.

7. Groups and Privacy

Groups on CourtTime are private by default. You can only join a group through an invitation link shared by an existing member or by being added by a group member. Your name and session activity are visible to other members of groups you belong to. Your phone number is never displayed to other users.

8. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by CourtTime and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTTIME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Assumption of Risk

You acknowledge that participation in court sports carries inherent risks of physical injury. CourtTime is a coordination tool and assumes no responsibility for injuries, accidents, or damages that may occur during playing sessions arranged through the Service. You participate in all sessions at your own risk.

12. Indemnification

You agree to indemnify, defend, and hold harmless CourtTime, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms. You may delete your account at any time through the Service or by contacting us. Upon termination, your right to use the Service ceases immediately.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
